On September 6, 2011, the Ministry of Human Resources and Social Security issued the Interim Measures for the Participation of Foreigners Employed in China in Social Insurance, which clearly stipulates that if foreigners are employed in China, then the company must purchase social security for them.

人力资源和社会保障部于2011年9月6日发布《在中国境内就业的外国人参加社会保险暂行办法》做出明确规定：外籍人士如果在中国就业，那么公司就必须为其购买社保。

China's Ministry of Human Resources and Social Security has already made corresponding agreements with many countries, and these agreements have become a special situation for foreigners to participate in social insurance in China.

我国人力资源和社会保障部早已与多个国家进行过相应协定，而这些协定就成为外国人在中国参与社会保险的特殊情况。

The reason why it is called special circumstances is because in addition to special circumstances, foreigners' participation in social insurance in China should be equivalent to that of Chinese citizens, and they should all participate in the five types of insurance of "pension, medical care, work injury, childbirth, and unemployment".

之所以称之为特殊情况，是因为除了特殊情况之外，外国人在中国参加社会保险应当等同于中国公民，均应参与“养老、医疗、工伤、生育、失业”五个险种。

二、Procedures for foreign personnel to participate in the insurance.

外籍人员参保办理流程

1、Through the online declaration system, apply for online declaration of enterprises logging on to the website of the Social Security Bureau.通过网上申报系统办理登录社保局网站企业网上申报;

2、Print the "Application for Employees to Participate in Social Insurance Personal Information Registration/Suspension / Transfer/Change of Insurance Type/Resumption of Insurance/Wage Change", and attach the application materials to the collection front desk.

打印《企业员工参加社会保险个人信息登记/停交/调动/险种变更/恢复参保/工资变动申请》、附上申请资料到征收前台办理。

在中国参加社会保险的外国人，符合条件的，依法享受社会保险待遇。
